Terms of Service

1. Who we are

LPS Constraint Tracker (the "Service") is a construction-project planning platform owned and operated by Koray Kuşcu ("we", "us", or the "Provider"). By accessing or using the Service you ("you" or "User") agree to be bound by these Terms of Service (the "Terms"). If you do not agree, do not use the Service.

2. Account & access

• Accounts are issued only to authorised users invited by an administrator of a subscribing organisation ("Tenant").
• You are responsible for keeping your credentials confidential and for all activity on your account.
• You must notify us immediately of any unauthorised access.
• We may suspend or terminate any account that violates these Terms, without prior notice.

3. Acceptable use

You agree not to, and not to permit any third party to:

• Reverse engineer, decompile, or extract the source code of the Service;
• Copy, redistribute, sublicense, resell, or host the Service or any part of it;
• Use the Service to build or improve a competing product;
• Upload malware, illegal content, or content that infringes third-party rights;
• Interfere with, probe, or attempt to gain unauthorised access to the Service or its infrastructure;
• Use the Service in breach of applicable law, including data protection and export-control regulations.

4. Intellectual property

The Service, including all source code, templates, stylesheets, scripts, database schema, documentation, and design elements, is the exclusive property of Koray Kuşcu and is protected by copyright and international treaty. No rights are granted to you except the limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.

5. Your data

• Ownership. You retain all rights, title, and interest in the data you upload to the Service (project data, activities, constraints, photos, documents). We claim no ownership over your data.
• Licence to operate. You grant us a limited licence to store, process, and display your data solely to operate the Service for you.
• Confidentiality. We will not disclose your data to third parties except as required to operate the Service or as required by law.
• Export. You may export your data at any time in the formats provided by the Service (Excel, PDF, JSON).

6. Availability

The Service is provided on an "as available" basis. We aim for high availability but do not guarantee uninterrupted access. Scheduled maintenance and unforeseen outages may occur.

7. Fees

Where fees apply, they are set out in a separate written agreement between us and the subscribing organisation. Fees are non-refundable except as required by mandatory local law.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM SECURITY VULNERABILITIES.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE PROVIDER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE SERVICE. OUR AGGREGATE LIABILITY UNDER OR IN CONNECTION WITH THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY THE SUBSCRIBING ORGANISATION TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

10. Termination

We may terminate your access to the Service immediately if you breach these Terms. On termination, your right to use the Service ends and we may delete your account and associated data after a reasonable grace period.

11. Changes to these Terms

We may revise these Terms from time to time. Material changes will be notified to Tenant administrators. Continued use of the Service after a change constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. The courts of İstanbul shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
